The Supreme Court of India has recently made a landmark observation over the statutory authority of Pharmacy Council of India (PCI) when it comes to matters related to pharmacy. The bench of Honourable Justices Arun Mishra, Vineet Saran and MR Shah held that only Pharmacy Act 1948 will be applicable in relation to the subject of Pharmacy, including approval of courses of study, minimum standards of education required for qualification as a Pharmacist, registration as a Pharmacist, regulation of future professional conduct etc; not any other authority. SC was approached to intervene in the conflict over restrictions imposed by the PCI on the intake of students to various Pharmaceutical courses. The newly passed out Doctoral Pharmacy (Pharm D) gradutates in Tamil Nadu will get multiple opportunities in pharma and allied health sectors as the state pharmacy council (TNPC) is continuing its discussion with the Indian Pharmaceutical Association (IPA) to consider and recommend Pharm D graduates for specialized posts in industry and in government sector. The pharmacy council is an autonomous body with lot of limitations of work. Apart from registration and renewal of certificates, the council is supposed to facilitate and support pharmacy education and updating the syllabus. But as a special case of interest, TNPC will take the issues of Pharm D holders with IPA which is the ideal organisation to discuss and analyse their issues. The HRD Ministry has worked out an agreement between All India Council for Technical Education (AICTE) and Pharmacy Council of India (PCI) to settle "regulatory discord" over running of pharmacy colleges. According to official sources, there are over 1,000 pharmacy colleges in the country which are regulated by AICTE while PCI, which comes under the Health Ministry, lays down norms for them. "There have been instances when the two bodies are not on the same page on key matters like fixing the number of seats in colleges. It is a case of jurisdictional overlapping. Recently, the Calcutta High Court had directed the HRD Ministry to resolve the conflict between these two regulatory bodies," an official source told.
